Please read these Terms of Service ("Terms", "Terms of Service") carefully before using the CarWashPro application and website (the "Service") operated by CarWashPro ("us", "we", or "our").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.

1. Definitions

• "Service" refers to the CarWashPro mobile application, website, and related cloud-based synchronization services.
• "User" refers to any individual or entity that creates an account or uses the Service.
• "User Content" refers to all data, text, and information uploaded or stored by a User within the Service.
• "Free Tier" refers to the base version of the application provided at no cost, which operates primarily as a local-first service.
• "Pro Tier" refers to the subscription-based version of the application offering cloud synchronization, staff management, and advanced reporting.

2. Eligibility and Account Registration

By using this Service, you represent that you are at least 16 years of age and possess the legal capacity to enter into a binding agreement. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

3. Subscriptions & Billing

CarWashPro offers various tiers of service. Payment for the Pro Tier is managed through third-party app stores (Apple App Store or Google Play Store). By subscribing, you agree to their respective terms and conditions.

• Automatic Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing cycle.
• Fees: We reserve the right to modify subscription fees at any time. Any fee changes will be communicated in advance.
• Refunds: Refund requests are handled by the platform through which the purchase was made. CarWashPro does not provide direct refunds for app store transactions.

4. User Responsibilities & Acceptable Use

As a user, you agree NOT to:

• Use the Service for any unlawful purpose or in violation of any local, state, or international law.
• Attempt to reverse engineer, decompile, or extract the source code of the Service.
• Interfere with or disrupt the integrity or performance of the Service.
• Upload or transmit any malicious code, viruses, or harmful data.
• Use the Service to infringe upon the intellectual property rights of others.

For Free Tier users, you acknowledge that data is stored locally on your device. You are solely responsible for performing regular backups of your data. CarWashPro is not liable for any data loss resulting from device failure, theft, or app deletion.

5. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of CarWashPro and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6. Data Protection and Privacy

Your privacy is important to us. Our collection and use of your personal information are governed by our Privacy Policy. By using the Service, you consent to the processing of your data as described therein. We comply with applicable data protection regulations regarding the handling of personal information.

7. Pro Tier Service Levels

While we strive for 99.9% uptime for our Cloud Sync and Staff Management features, these services depend on third-party infrastructure and internet connectivity. We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free.

8. Limitation of Liability

To the maximum extent permitted by law, CarWashPro shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Service.
• Any conduct or content of any third party on the Service.
• Unauthorized access, use, or alteration of your transmissions or content.

9. Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Indemnification

You agree to defend, indemnify, and hold harmless CarWashPro and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of your use and access of the Service, or a breach of these Terms.

11. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including but not limited to a breach of the Terms. Upon termination, your right to use the Service will immediately cease.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which the Service operates, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
